TruGreen agrees to pay $4.5 million for TCPA violations

TruGreen_logoTruGreen agreed to pay $4.45 million to a class of plaintiffs alleging it violated the Telephone Consumer Protection Act (TCPA) by making unsolicited phone calls on or after May 29, 2009, according to Law360.

The $4.45 million fund will be used to pay up to $500 to each class member who submits a valid claim form. Plaintiff Faustino Chapa alleged TruGreen had used an automatic dialing system to call 214,153 unique cellphone numbers. The TCPA prohibits using an automatic dialer to call a cellphone without prior consent.
